Terms of Sale.

1. Seller and scope

These terms apply to all purchases from the GES Art House, the art branch of Global Equine Solutions, owner Lucas Brandt, Am Kaiserkai 6, 20457 Hamburg, Germany, email info@globalequine.co (the Seller). They apply to consumers and businesses; where a clause applies to consumers only it says so. Orders are placed through the selection on globalequine.co and the checkout on shop.globalequine.co, which runs on the Shopify platform.

2. What we sell

Every piece is made to order: a painting on canvas, or a denim jacket, hoodie, t-shirt or pair of sneakers, hand-painted by the artist from a photograph you supply. It is a personalised object produced for you alone. Sizes, the number of horses included per canvas size, and the options available are shown on the product page at the time of order. Photographs of earlier works are examples; your piece is painted from your photograph and will differ in detail.

3. Ordering and contract

Adding a piece to your selection is not yet an order. The contract is concluded when you complete the checkout and we send the order confirmation by email. We may decline an order within five working days if the photograph you send cannot be painted from and no usable alternative is available; in that case any payment is refunded in full.

4. Prices and payment

Prices are in euro and include VAT at the applicable rate. Shipping is shown at checkout. Pieces under EUR 1,000 and all wearables are paid in full at checkout. Paintings from EUR 1,000 are paid with a 50 percent deposit at checkout; the balance is due by payment link within 14 days after we send you the photograph of the finished piece, and the piece ships once the balance is received. If the balance is not paid within 14 days after a reminder, we may withdraw from the contract; the deposit then covers the work already done and is not refunded. Payment methods are those offered at checkout by Shopify Payments.

5. The photograph and the draft

After checkout you send the photograph of your horse through the link in your order confirmation or at globalequine.co/art/brief. Nothing is painted before it arrives. You then receive a positioning draft, a mockup of where the horse sits on the canvas or garment, for approval. Painting starts only after your approval. If no photograph you supply can be painted from, we tell you and help you take a better one. There is no deadline for the photograph: the order stays open until it arrives, and the piece is painted then. Supplying a usable photograph is your part of the contract; payment is not refunded because a photograph has not been sent.

6. Delivery time

Every piece is painted after your order. The delivery window depends on the piece, the number of horses and the studio queue and is confirmed with you personally after the draft is approved. No fixed delivery date is agreed at checkout. If an agreed window cannot be met, we tell you before it passes and agree a new one with you.

7. Shipping, customs and risk

Pieces ship from Hamburg, Germany, to the delivery address in your order, packed for transport and insured until delivery. Within the European Union no customs charges arise. For deliveries outside the EU, import duties, taxes and carrier handling fees at the destination are payable by the buyer. For consumers, the risk of loss or damage passes on delivery. If a piece arrives damaged, write to us as soon as possible with photographs of the packaging and the piece; we look at each case individually, without prejudice to your statutory rights.

8. Withdrawal notice for consumers (Widerrufsbelehrung)

No right of withdrawal for made-to-order pieces. Under § 312g Abs. 2 Nr. 1 BGB and Article 16(c) of Directive 2011/83/EU, the right of withdrawal does not apply to goods that are made to the consumer's specifications or are clearly personalised. Every Art House piece is painted from your photograph for you alone and is therefore excluded from the statutory right of withdrawal.

Where a right of withdrawal exists (for example an add-on that is not personalised, such as a presentation box ordered without a piece), you have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you, other than the carrier, takes possession of the goods. To exercise the right you must inform us, Global Equine Solutions, Am Kaiserkai 6, 20457 Hamburg, Germany, email info@globalequine.co, of your decision by a clear statement, for example a letter or an email; you may use the model form below. To meet the deadline it is sufficient to send your communication before the period expires. If you withdraw, we refund all payments received from you, including delivery costs except additional costs from a delivery option other than our cheapest standard delivery, without undue delay and within 14 days of receiving your withdrawal, using the same means of payment you used, at no cost to you. We may withhold the refund until we have received the goods back or you have supplied evidence of having sent them back. You must send the goods back without undue delay and in any event within 14 days of informing us. You bear the direct cost of returning the goods. You are liable only for any diminished value resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

9. Defects and warranty

Your statutory warranty rights apply. A piece painted from your photograph is a work of art; small differences from the photograph, visible brushwork and variation in the texture of the ground are characteristics of the technique and not defects. Approval of the positioning draft covers the position and orientation of the horse, not the finished painting.

10. The register, the certificate and copyright

Each piece is entered in the GES Art House register under a number and delivered with a signed, numbered certificate. The artist retains the copyright in the work. You acquire ownership of the physical piece and may display and resell it; reproduction, licensing or commercial use of the image requires the artist's written consent. By sending a photograph you confirm that you have the right to have it painted and shown to the artist.

11. Data

Order and payment data are processed by Shopify and the payment provider; the photograph and the brief reach us by email. Details are in our Privacy Policy.

12. Law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory consumer protection rules of the country of your habitual residence remain unaffected. For businesses, the place of jurisdiction is Hamburg. The European Commission's online dispute resolution platform has been discontinued; we are neither obliged nor willing to take part in dispute resolution before a consumer arbitration board.
